These Contractor Lead Terms & Conditions ("Terms") apply to contractors who purchase lawn-care customer leads through Mowing Pro Lawns and/or its associated lead-generation service NZ Lawn Leads("we", "us", "our").
By purchasing a lead, or by ticking the acceptance box and completing payment through Stripe, you ("the Contractor", "you", "your") agree to these Terms.
1. What is a lead?Our lead service connects lawn-care contractors with customers who have contacted us seeking lawn mowing or related lawn-care services.
Leads may be received through telephone calls, text messages, emails, website enquiries, social media or other communication channels.
We aim to provide genuine enquiries from people who are actively looking for a lawn-care contractor.
Lead posts will generally provide information such as:
Type of work required — regular or one-off
General area or suburb
Approximate lawn size
Whether the lawn is maintained or overgrown
Any other relevant information available from the customer's enquiry
We will provide the customer information we have available and consider relevant to the enquiry.
2. Hot leadsOur leads are intended to be hot leads from people genuinely looking for a contractor at the time of the enquiry.
However, we cannot guarantee that:
The customer will answer your call
The customer will accept your quotation
The customer will proceed with the work
The customer will become a regular customer
The customer will choose your proposed price
The work will ultimately be completed
The purchase of a lead is therefore the purchase of access to a customer enquiry, not a guarantee of a sale or a particular amount of work.
3. Lead pricingThe price of each lead will be clearly displayed before payment.
Unless otherwise stated, prices are in New Zealand dollars (NZD).
Different lead types may have different prices. For example, regular mowing leads may be priced differently from one-off mowing enquiries or larger commercial/residential properties.
The price displayed at checkout is the price payable for that lead.
4. How leads are claimedLeads may be posted in our Facebook group or made available to contractors through other channels.
Where a lead is offered on a first-to-reply basis, contractors may indicate their interest by replying "YES" or as otherwise instructed in the lead post.
The first eligible contractor to respond will normally be offered the opportunity to purchase the lead.
A lead is not considered sold or allocated until payment has been successfully received.
We reserve the right to withdraw a lead before payment if the customer is no longer available, the enquiry has been withdrawn, or for another reasonable reason.
5. PaymentPayment must be made through the payment method provided by us, currently Stripe.
Customer details will not be released until successful payment has been received.
Once payment has been confirmed, we will provide the customer details and relevant information available for that lead.
6. Exclusive leadsWhere a lead is described as exclusive, the customer will be supplied to one purchasing contractor only through our lead service.
Once an exclusive lead has been successfully purchased, we will not knowingly sell or supply the same customer enquiry to another contractor through our service.
Exclusivity applies to our lead service and does not prevent the customer from independently contacting other contractors, finding another contractor themselves, or having previously contacted another contractor.
7. Contacting the customerOnce you receive a lead, you are responsible for contacting the customer promptly.
You are responsible for:
Contacting the customer
Discussing their requirements
Inspecting or assessing the property where necessary
Providing your own quotation
Agreeing on the price and scope of work
Arranging a suitable time
Completing the work
Handling all ongoing communication with the customer
We do not provide quotations on your behalf unless specifically agreed otherwise.
8. Contractor responsibilitiesYou operate as an independent contractor and are solely responsible for your own business.
You are responsible for ensuring that you have:
Appropriate business registration where required
Appropriate insurance
Suitable equipment
Safe working practices
Any licences, qualifications or permits required for your work
Responsibility for your own tax and GST obligations
Compliance with all applicable New Zealand laws and regulations
We are not your employer, partner, agent or joint venture partner.
9. Customer relationshipOnce you have purchased an exclusive lead, the customer is yours to pursue as a potential client.
If the customer accepts your quotation and engages you, the ongoing customer relationship is between you and the customer.
You are responsible for all subsequent work, pricing, invoicing, complaints, warranties, refunds and other matters relating to the services you provide.
10. Lead quality and refundsWe make reasonable efforts to ensure that leads supplied through our service are genuine customer enquiries.
However, because the customer ultimately decides whether to proceed, we do not offer refunds simply because a customer does not accept your quotation, does not answer your phone, changes their mind, chooses another contractor, or does not proceed with the work.
We may consider a refund or replacement lead where, for example:
The enquiry was not genuine
The contact information supplied was materially incorrect
The customer confirms that they did not make the enquiry
The same lead was accidentally sold to more than one contractor as an exclusive lead
We supplied a materially different lead from the one described
Any request for a refund or replacement should be made as soon as reasonably possible after the issue is discovered.
We reserve the right to investigate any refund request before making a decision.
11. No guarantee of workPurchasing a lead does not guarantee that you will obtain work from the customer.
The customer remains free to:
Request a quotation
Decline your quotation
Negotiate your price
Choose another contractor
Cancel the requested work
Decide not to proceed
We cannot control the customer's decision or the outcome of your interaction with the customer.
12. Customer information and privacyCustomer information supplied to you is provided for the purpose of contacting the customer regarding the lawn-care service they have requested.
You must:
Keep customer information secure
Use the information only for the purpose for which it was supplied
Not sell, share, publish or resell customer information
Not add customer information to unrelated marketing databases without an appropriate lawful basis
Not use the information for unrelated products or services
Take reasonable steps to prevent unauthorised access or disclosure
You must comply with your own obligations under the New Zealand Privacy Act 2020 and any other applicable privacy requirements.
The Privacy Act applies to businesses and sole traders operating in New Zealand, and organisations need to handle personal information appropriately.
13. Customer follow-upWe reserve the right to contact a customer after their enquiry has been supplied to a contractor.
This may be done to:
Confirm that the contractor made contact
Check that the customer received the service they were seeking
Check the quality of the lead
Obtain feedback about the lead service
Investigate a complaint or dispute
This follow-up is also intended to help us monitor and maintain the quality of our lead service.
14. No interference with the lead serviceContractors must not attempt to circumvent the lead service by:
Sharing customer details with other contractors
Reselling leads
Using customer information to recruit other contractors
Attempting to obtain leads from our customers outside the agreed lead process
Misrepresenting themselves as an employee or representative of our business
15. Accuracy of informationWe provide information based on what the customer tells us and information reasonably available to us at the time.
Descriptions such as lawn size, condition and frequency are generally approximate.
The contractor is responsible for independently assessing the property and confirming the customer's requirements before providing a quotation.
We do not guarantee that an estimated lawn size, condition or description will be exactly accurate.
16. Changes to the lead service
We may change:
Lead prices
Lead categories
How leads are distributed
How leads are advertised
Payment methods
The areas in which leads are available
The way contractors claim leads
Any change will apply to future leads and will not retrospectively alter a lead that has already been purchased, unless required by law.
17. Suspension or refusal of serviceWe reserve the right to refuse or suspend access to the lead service where a contractor:
Fails to pay for leads
Misuses customer information
Breaches these Terms
Repeatedly fails to contact customers
Behaves inappropriately towards customers or other contractors
Provides misleading information
Attempts to circumvent the lead system
Where appropriate, we may also contact customers to investigate concerns about a contractor.
18. Limitation of responsibilityWe provide a lead-generation and customer-referral service. We do not provide the lawn-mowing services themselves.
We are not responsible for:
The quality of work performed by a contractor
Damage caused by a contractor
Injuries occurring during work performed by a contractor
Disputes between a contractor and customer
The contractor's pricing
Whether the contractor wins the work
Loss of income or business resulting from a customer not proceeding
Nothing in these Terms is intended to exclude or limit any legal right or obligation that cannot lawfully be excluded or limited.
19. Agreement between businessesThe lead service is intended for contractors operating as businesses or persons in trade.
By purchasing a lead, you acknowledge that you are purchasing the lead for business purposes.
Where applicable, the parties may agree in writing to contract out of provisions of the Consumer Guarantees Act 1993 where legally permitted and where the requirements for doing so are met. NZ guidance confirms that businesses can contract out of the CGA in certain business-to-business circumstances, provided the requirements are satisfied.
Nothing in these Terms is intended to exclude rights or obligations that cannot legally be excluded.
20. DisputesIf you have a concern about a lead or our service, please contact us first so that we have an opportunity to investigate and resolve the issue.
We will consider disputes reasonably and may request information from the contractor or customer where necessary.
These Terms are governed by the laws of New Zealand.
21. Acceptance of these TermsBy ticking the "I agree to the Terms of Service" box and completing payment for a lead, you confirm that:
You have read these Terms
You understand what you are purchasing
You agree to be bound by these Terms
You understand that purchasing a lead does not guarantee that you will obtain the work
You understand that the customer information supplied to you must be handled appropriately and only used for the purpose of responding to the customer's enquiry
